1. Agreement to Terms

By requesting, booking, or using services provided by Lengkeek Custom (“we,” “us,” or “our”), you (“the client”) agree to be bound by these Terms and Conditions. These terms apply to all work performed unless otherwise agreed to in writing.

2. Scope of Services

Lengkeek Custom provides agricultural barn cleanout and sanitation services. The exact scope of work, including whether services involve dry cleaning, manure removal, pressure washing, or disinfection, will be agreed upon prior to the start of each job. Any additional work requested beyond the agreed scope may result in additional charges.

3. Scheduling and Access

Clients must provide a minimum of three days’ notice for scheduling. All work is subject to availability, weather conditions, and operational factors. The client is responsible for ensuring the worksite is accessible and safe for equipment and personnel, including adequate clearance, unobstructed entry, and appropriate working conditions. If site conditions are unsafe or unsuitable, we reserve the right to delay, modify, or stop work without liability.

4. Pricing and Payment

All pricing is based on the information provided by the client and the observed condition of the site. Quotes are estimates and may be adjusted if actual conditions differ. Payment is due upon completion of services unless otherwise agreed in writing. We reserve the right to charge additional fees for delays, unexpected conditions, or changes in scope.

5. Equipment and Biosecurity

We take reasonable measures to clean and disinfect equipment between jobs; however, no guarantee is made that all pathogens, bacteria, or contaminants will be eliminated. The client acknowledges that agricultural environments carry inherent biosecurity risks and agrees that overall farm biosecurity remains the responsibility of the client.

6. Limitation of Liability

To the fullest extent permitted by law, Lengkeek Custom and its subsidaries shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of income, flock/livestock issues, production losses, or business interruption. Our total liability for any claim related to services provided shall be limited to the amount paid for those services. We are not responsible for pre-existing conditions, structural issues, hidden hazards, or equipment failures within the barn or property.

7. Client Responsibility

The client is responsible for ensuring that all animals are removed where required, utilities are properly managed, and the site is prepared for service. The client must disclose any known hazards or special conditions prior to the start of work. Failure to do so may result in delays, additional charges, or cancellation of services.

8. Cancellations

Cancellations must be made with reasonable notice. We reserve the right to charge a fee for late cancellations or missed appointments to account for lost time and operational costs.

9. Indemnification

The client agrees to indemnify and hold harmless Lengkeek Custom from any claims, damages, or expenses arising from the condition of the worksite, the client’s failure to meet responsibilities outlined in these terms, or circumstances beyond our control.

10. Governing Law

These Terms and Conditions shall be governed by the laws of the Province of British Columbia and applicable Canadian laws.

11. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of any changes.
